Computer forensics is the science (and art) of identifying and retrieving information from electronic devices, often after it has been deleted or otherwise altered. It is a subset of electronic discovery, the more-or-less voluntary exchange of discoverable material stored in electronic form.

ComputerForensicsDigest.com is devoted to tracking and summarizing federal and state cases involving computer forensics. Priority is given to cases in which some aspect of the computer forensics process is at issue, either as part of a pre-trial motion or on appeal. Not surprisingly, the bulk of these cases will involve disputes over the seizure and search of electronic devices. Some cases will be noted and summarized when there is a particularly thorough discussion of the computer forensics process, or where computer forensics is used in an unusual way.

In addition to case summaries, this site will also track news stories dealing with computer forensics, and over time, will create and maintain a computer forensics resource guide aimed at assisting attorneys in understanding this burgeoning litigation field. Another closely-related goal is helping subscribers keep pace with the technological innovations that make computer forensics and electronic discovery both fascinating and daunting.

Subscribers will receive a periodic newsletter listing developments in the area of computer forensics, as well as a listing of new materials added to the website.

Over time, this site will expand to include other computer forensics materials, including:

  • A Computer Forensics Manual for Lawyers
  • Pre-packaged legal research memoranda on specific computer forensics topics
  • Copies of pleadings and briefs dealing with computer forensics issues
  • Miscellaneous materials relating to computer forensics
  • Links to suppliers of forensic hardware
  • Links to suppliers of forensic software

Eventually, the coverage of this site will expand to include cases and materials related to the broader category of electronic discovery.
